What this letter is
Your landlord ending the tenancy. In Germany a landlord can only terminate an ordinary residential lease for a legally valid reason — most commonly Eigenbedarf (they or a close family member need the flat). The notice must be in writing, state the reason, and give a notice period that grows with how long you have lived there (3 months up to 5 years, 6 up to 8 years, 9 months beyond). It is neither immediate nor always valid.
What to do
- Read the reason and the deadline. A termination with no stated valid reason, or in the wrong notice period, is generally ineffective.
- Don't move out on the spot. You keep full rights until the correct period ends, and the termination can be challenged.
- Eigenbedarf is often contestable — it must be concrete and genuine; "pretextual" Eigenbedarf is unlawful. You may also object on hardship grounds (Härtefall: illness, age, no affordable alternative).
- Get it checked fast. A Mieterverein or tenancy lawyer can tell you within a week whether the notice holds — the deadlines to object are short.
- Don't confuse it with your own move-out. If you want to leave, your notice period as a tenant is a flat 3 months regardless of how long you have lived there.
