My residence permit application was refused
The situation
A negative decision (Ablehnung) arrived from the Ausländerbehörde. It is frightening and full of legal German, and it usually carries a short deadline to act — which is easy to miss in the panic.
The way out
A refusal is often not the end — but the deadline on it is unforgiving. Act on the date, not on your feelings.
- Find the deadline first. The Rechtsbehelfsbelehrung at the end states how long you have to respond — commonly one month. Everything below depends on not missing it.
- You usually have two routes: a formal objection (Widerspruch) where that procedure exists, or a lawsuit (Klage) at the Verwaltungsgericht. The notice itself tells you which applies.
- Get a specialist lawyer now, not later — a Fachanwalt für Migrationsrecht. The letter's stated reasons tell them quickly whether it is beatable, and many first refusals are.
- Do not just leave or overstay. Filing in time usually preserves your status while it is reviewed; walking away can forfeit rights you still hold.
- Gather what was missing. The reason often points to a fixable gap — funds, insurance, a document — that a fresh application or the objection can cure.
