My visa expires before my appointment
The situation
Your D visa or permit runs out in a few weeks, the Ausländerbehörde hasn't replied or booked you, and panic is setting in. The most common fear among internationals — and the most manageable.
The way out
The key principle: applying on time protects you, not the appointment date.
- Get your application on record before expiry — online form, email with documents, or whatever your city's channel is. The moment your extension request is provably filed, your stay remains legal while it processes (§81 AufenthG effect), even months past the card date.
- Keep dated evidence: sent emails, portal confirmations, screenshots. This is your shield.
- Need to prove status or travel? Request a Fiktionsbescheinigung explicitly — the bridging certificate showing your rights continue. For travel outside Germany it's essential; for daily life your evidence stack usually suffices.
- Employer or university nervous? Show them the application evidence and point them to the Fiktionswirkung rule — HR departments in university towns know it well.
- Never just overstay silently without a filed application — that's the one version of this story that actually goes wrong.
Rule for next time: contact the office 8–10 weeks before expiry (3 months in Munich).
